Pro Event Staffing Inc. dba ProEvnt ("ProEvnt," "we," "us," or "our") operates the BlackTux platform (the "Platform"). This Privacy Policy explains what personal information we collect from Contractors (also referred to as "Staff" in user-facing materials) ("you"), how we use it, and your rights regarding that information. By using the Platform or creating a Contractor profile, you agree to the practices described in this Policy.

1. INFORMATION WE COLLECT

We collect personal information that you provide when creating or maintaining a Contractor profile, as well as certain technical information automatically generated through your use of the Platform, including the following:

1.1. Identity & Contact Information

  • Full legal name
  • Home address
  • Phone number
  • Email address
  • Date of birth (for compliance and payroll purposes)
  • Government-issued identification (e.g., driver's license or state ID), used for identity and eligibility verification

1.2. Tax & Payment Information

  • Social Security Number (SSN) — used solely for tax reporting and payment processing purposes and not shared with event clients. Such information is stored using appropriate security safeguards and may be shared only with authorized payroll or tax processing providers as required for payment and regulatory compliance.

1.3. Professional Profile Information

  • Profile photo / headshot
  • Physical measurements and sizes (height, clothing, shoe size, etc.) — used for uniform matching and client look books
  • Languages spoken
  • Professional licenses and certifications (e.g., bartending license, food handler's permit, driver's license)
  • Social media profile URLs (e.g., Instagram, LinkedIn) — used for look book and brand ambassador matching
  • Work experience and assignment history within the Platform
  • Contractor tier level and performance ratings

1.4. Availability & Scheduling Data

  • Availability windows you submit through the Platform
  • Assignment acceptances, declines, and no-show history

1.5. Location Data

  • GPS location — collected only during accepted assignments for geo-fenced check-in and check-out verification
  • We do not track your location outside of accepted assignments

1.6. Device & Usage Data

  • Device type and operating system
  • Platform usage logs (login times, features accessed)
  • Push notification preferences

You are responsible for ensuring that the information you provide through the Platform is accurate and up to date. Inaccurate or outdated information may affect your eligibility for assignments or your ability to receive payments.

2. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

  • Assignment matching — to match you with event opportunities based on your profile, availability, tier, measurements, licenses, client preferences, and other assignment-related criteria
  • Payroll and tax reporting — to process your earnings and issue 1099 forms as required by law
  • Identity and eligibility verification, including age verification for alcohol service roles
  • Communication — to notify you of assignment opportunities, confirmations, assignment changes, and Platform updates
  • Look books and client-facing materials — your photo and professional information may be included in Contractor look books presented to clients (social media links included with your consent)
  • Performance tracking — to record assignment history, ratings, and appreciation points
  • Compliance — to verify licenses and certifications required for certain events
  • Platform improvement — to understand how the Platform is used and improve features
  • Security and fraud prevention — to detect, investigate, and prevent unauthorized use of the Platform or violations of platform policies
  • In addition, we may also use analytics or diagnostic tools to understand how the Platform is used, monitor performance, and improve platform functionality.

3. HOW WE SHARE YOUR INFORMATION

ProEvnt does not sell your personal information. We may share your information in the following limited circumstances:

  • With clients — limited professional profile information (photo, tier, relevant experience, measurements for uniform purposes) may be shared with event clients as part of Contractor look books or assignment confirmations. SSN, bank details, and personal contact information are never shared with clients.
  • With service providers — ProEvnt may engage third-party service providers to support the operation of the Platform, including hosting providers, analytics tools, payroll, payment processors, scheduling, platform operations and technical infrastructure vendors. These service providers are permitted to process personal information only as necessary to provide services to ProEvnt and are contractually required to maintain appropriate confidentiality and security safeguards.
  • For legal compliance — if required by law, court order, or government regulation, we may disclose information to the appropriate authorities.
  • Business transfers — in the event of a merger, acquisition, or sale of ProEvnt, Contractor data may be transferred as part of that transaction. You will be notified in advance.

4. DATA RETENTION

We retain your information for as long as you maintain a Contractor profile with ProEvnt. If your profile is deactivated or you request deletion:

  • Personal profile information will be deleted within 90 days of your request
  • Tax and payroll records (including SSN and earnings history) are retained for a minimum of 7 years as required by federal and New York State tax law
  • Assignment history and performance data may be retained in anonymized form for internal records
  • Certain information may be retained for longer periods where necessary to comply with legal obligations, resolve disputes, enforce agreements, or maintain business records

5. DATA SECURITY

We take reasonable technical and organizational measures to protect your personal information against unauthorized access, loss, or disclosure. Sensitive information such as SSN and bank account details are stored using industry-standard encryption. However, no system is completely secure — if you believe your information has been compromised, contact us immediately. In the event of a data security incident affecting your personal information, ProEvnt will provide notice to affected individuals in accordance with applicable law.

6. YOUR RIGHTS

As a ProEvnt Contractor, you have the following rights regarding your personal information:

  • Access — you may request a copy of the personal information we hold about you
  • Correction — you may update or correct your information directly in the Platform or by contacting us
  • Deletion — you may request deletion of your profile and personal information, subject to legal retention requirements
  • Portability — you may request your data in a portable format

To protect your privacy and security, ProEvnt may take reasonable steps to verify your identity before fulfilling a request to access, modify, or delete personal information.

7. LOCATION DATA — ADDITIONAL NOTICE

The Platform uses GPS location services exclusively for assignment check-in and check-out verification (geo-fencing). Location access is only active during an accepted assignment. We do not monitor, store, or share your location data outside of assignment check-in/check-out events. You may disable location services on your device at any time, but this will prevent you from checking in or out of assignments through the Platform.

8. SOCIAL MEDIA INFORMATION

If you provide social media profile URLs (e.g., Instagram, LinkedIn), this information may be included in look books or profile materials shared with clients for brand ambassador or promotional staffing purposes. You may remove your social media links from your profile at any time through the Platform settings. Providing social media profile links is voluntary and may be removed from your profile at any time.

9. CHILDREN

The BlackTux Platform is intended for use by working adults who are 18 years of age or older. We do not knowingly collect personal information from individuals under the age of 18. If you believe a person under 18 has created an account, please contact us immediately so we can deactivate the account and delete any collected data.

10. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. When we do, we will notify you through the Platform and update the "Last Updated" date at the top of this document. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Policy. For material changes to this Privacy Policy, we may, but are not required to, request that users review and acknowledge the updated Policy before continuing to use the Platform.

This Privacy Policy is governed by the laws of the State of New York.

12. ELECTRONIC ACCEPTANCE

By using the Platform or creating a Contractor profile, you confirm that you have read, understood, and agree to this Privacy Policy. Acceptance through the Platform, including by checking an "I agree" box, clicking an acceptance button, or typing a name electronically, constitutes valid and binding consent to the data collection, use, and sharing practices described in this Policy and shall have the same force and effect as a handwritten signature.
